Welcome to Outside the Box Trainings (www.outsidetheboxtrainings.com). This website is owned and operated by OTB Learning Group, LLC (“Company,” “we,” “us,” or “our”).

By accessing our website, purchasing our courses, or using our services, you (the “User,” “Student,” or “Customer”) agree to be bound by the following Terms and Conditions (“Terms”). Please read them carefully. If you do not agree to these Terms, you must not use this website or our services.

1. Scope of Services

OTB Learning Group, LLC provides professional education, continuing education units (CEUs), professional development units (PDUs), and workforce training for professionals in Applied Behavior Analysis (ABA), behavioral health, and education. Our services include, but are not limited to:

  • The 40-hour Behavior Technician Certification Course.
  • Self-paced CEUs/PDUs for RBTs, BCBAs, Student Analysts, and QABA®/IBAO® credentialed professionals.
  • Organizational compliance training (HIPAA, FERPA, Mandated Reporter, Cultural Competency).
  • Specialized training libraries for EMR and practice management platforms.

Issuing Name on CEUs/Certificates (Trade Name Notice): For credentialing and compliance purposes (including BACB® and IBAO® documentation), you acknowledge and agree that some CEUs, certificates of completion, and other professional training certificates may be issued under the trade name “Outside the Box Behavioral Services,” which is owned and operated by OTB Learning Group, LLC. This trade name refers to the same Company and does not change your relationship with OTB Learning Group, LLC under these Terms.

1A. Cohort Live Zoom Sessions (Attendance, Participation, and Recordings)

If a course, cohort, workshop, or training includes live virtual sessions (including “Cohort Live Zoom Sessions”), you must meet any stated attendance and participation requirements (including punctuality, time-on-camera where required, and completion of any live activities, polls, or check-ins) in order to receive credit, a certificate, CEUs/PDUs, or any other completion documentation for that live component.

Recordings (If Any): If we choose to record a live session, access to recordings (and the length of time they remain available) is provided at the Company’s sole discretion and may be limited, delayed, edited, or unavailable due to privacy, platform, technical, or instructional reasons. Where permitted by law and our policies, recordings are provided for convenience and do not waive or replace any attendance/participation requirements unless we state otherwise in writing.

2. Professional Disclaimer

Not Clinical Advice: The content provided on this website and within our courses is for educational and informational purposes only. It does not constitute clinical advice, medical diagnosis, or a therapeutic relationship.

Independent Training & Certification Disclaimer: “The Behavior Technician Mixtape” and our other trainings are independent educational programs offered by OTB Learning Group, LLC. They are not owned, operated, endorsed, sponsored, or approved by the Behavior Analyst Certification Board (“BACB®”), the Qualified Applied Behavior Analysis Credentialing Board (“QABA®”), or the International Behavior Analysis Organization (“IBAO®”).

No Guarantee of Certification / Employment / Exam Approval: While our courses may be designed to align with certain training requirements published by BACB®, QABA®, and/or IBAO®, completion of any training does not guarantee (a) certification or credential issuance, (b) employment, (c) eligibility to sit for any exam, (d) exam approval, or (e) the outcome of any application, audit, background check, competency assessment, supervision requirement, or credential review. Requirements may change, vary by credential, and are administered solely by the applicable credentialing board and/or your employer.

Trademark Disclaimer: BACB®, QABA®, IBAO®, and any related credential names and marks (including, as applicable, RBT®, BCBA®, BCaBA®, ABAT®, IBT, and similar acronyms) are trademarks/service marks owned by their respective organizations. Any use on our website or in our materials is for identification and reference purposes only and does not imply affiliation or endorsement.

Learner Responsibility: Users are solely responsible for confirming and meeting all current requirements (including documentation, supervision/competency assessment, ethical standards, and renewal rules) established by the applicable credentialing board(s) and/or employer.

3. User Accounts and Access

  • Eligibility / User Representations: You represent and warrant that you are at least 18 years of age and that any information you provide to us (including registration, enrollment, checkout, and account profile information) is true, accurate, current, and complete. You agree to promptly update your information if it changes.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account.
  • One User Per Account: Access to courses is granted to a single individual. Sharing login credentials, “group viewing” of individual-license courses, or distributing course content to non-registered users is strictly prohibited and may result in immediate termination of access without refund.

3A. Competency Assessment & Third-Party Services

Some credentials and/or employers require additional components beyond coursework completion (for example, competency assessments, supervised fieldwork, background checks, or employer verification).

  • Separate Services / Separate Agreements: If you request or are offered competency assessment, supervision coordination, or related support services, those services may be coordinated through Sorella ABA and/or other third-party providers, affiliates, contractors, or partner organizations (collectively, “Assessment Providers”). Such services may require you to enter into a separate contractual agreement (including separate fees, scheduling policies, cancellation policies, consent forms, and documentation requirements) with the applicable Assessment Provider(s).
  • No Guaranteed Availability: We do not guarantee that competency assessment or supervision services will be available in your area, within a particular timeframe, or at all.
  • Learner Responsibility / Board Compliance: You remain solely responsible for meeting all credentialing board and employer requirements (including ethics, documentation, deadlines, and eligibility rules). You are also responsible for confirming that any Assessment Provider you use meets the applicable board’s requirements.
  • Right to Deny or Suspend Assessment Services: To the fullest extent permitted by law, we (and/or an Assessment Provider) reserve the right to deny, pause, discontinue, or suspend assessment coordination or related services if we reasonably believe you (a) provided inaccurate information, (b) engaged in academic dishonesty, fraud, misrepresentation, or unethical conduct, or (c) failed to meet applicable ethical standards, board rules, legal requirements, or professional conduct expectations.
  • No Board Authority: We do not control, and are not responsible for, decisions made by BACB®, QABA®, IBAO®, exam administrators, employers, or any third party regarding eligibility, approval, certification, employment, or disciplinary actions.

4. Intellectual Property Rights

All content on this website and within our training programs—including but not limited to “The Behavior Technician Mixtape,” all course avatars and avatar content, scripts, skits, lesson frameworks, prompts, assessments, instructor manuals, worksheets, videos, audio, graphics, logos, trademarks, service marks, page layouts, design elements, and our proprietary pop-culture–driven, behavior-based training methods (collectively, “Content”)—is the exclusive property of OTB Learning Group, LLC (or used with permission) and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

Limited License to Use: Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the Content solely for your individual educational use. No ownership interest is transferred to you.

Strict Prohibitions (No Recording / No Scraping / No Screenshots / No Redistribution / No Derivatives): Except where we expressly authorize in writing, you shall not, and shall not permit any third party to:

  • Record (audio or video), stream, rebroadcast, or otherwise capture any portion of the Content, including by screen recording, external cameras, or device-to-device recording.
  • Copy, download, screenshot, photograph, scan, scrape, data-mine, crawl, harvest, extract, or reproduce the Content (in whole or in part), except for materials clearly labeled by us as downloadable.
  • Share, distribute, sell, sublicense, publish, upload, post, transmit, or make available the Content to any other person (including coworkers, classmates, group chats, forums, social media, file-sharing sites, or other websites).
  • Create, develop, or distribute derivative works based on the Content, including the avatars, scripts, or our pop-culture–driven training methods (e.g., re-writing scripts, replicating characters, converting lessons to your own course, adapting our framework for a training library, or using our approach to train others).
  • Use the Content to create or support a competing course, training program, coaching offer, consulting package, certification prep product, or content library.
  • Remove, alter, or obscure any copyright, trademark, watermark, attribution, or proprietary notices.

Enforcement: Unauthorized use of the Content may result in immediate termination of access (without refund), and may subject you to legal liability, including injunctive relief and damages.

5. Payments, Refunds, and Cancellations

  • Pricing: Prices for courses and services are subject to change without notice.
  • Refunds & Cancellations: All purchases are subject to the Company’s standalone Refund and Cancellation Policy, which is incorporated into these Terms by reference. Please review that policy (available on our website) prior to purchase.

6. Community Impact Initiative

OTB Learning Group, LLC is committed to workforce equity. We offer a limited number of free training spots for our 40-hour course each quarter. Selection for these spots is at the sole discretion of the Company, and the availability of this program does not create a legal entitlement for any applicant.

7. User Conduct

You agree to use the website for lawful purposes only.

7A. Prohibited Activities

You are prohibited from (and agree you will not attempt to), directly or indirectly:

  • Scrape, crawl, spider, data-mine, harvest, extract, or index any portion of the website or Content, including through bots, automation tools, AI tools, scripts, or third-party services, except as permitted by applicable law and our express written consent.
  • Screenshot, screen record, record, reproduce, download, redistribute, publish, upload, or share any Content except as expressly permitted by us in writing.

  • Share login credentials, provide access to your account to others, or otherwise enable any person to access Content using your account.
  • Use the website or Content for any commercial or competing purpose, including to train others, create a competing course/library, or develop competing products or services using our methods, scripts, avatars, or frameworks.
  • Engage in any behavior that is unlawful, defamatory, harassing, hateful, discriminatory, or culturally insensitive within our community forums, comments, or communications.
  • Harass, threaten, or abuse Company personnel, contractors, instructors, moderators, customer support, or other users.
  • Post, transmit, or distribute malware, spyware, ransomware, or other harmful code, or send unauthorized advertising, solicitations, or spam.
  • Use the website in a way that infringes any third-party rights, including intellectual property, privacy, or publicity rights.

We reserve the right to investigate suspected violations and to suspend or terminate access (without refund where applicable) as permitted by law.

8. Compliance and Ethics

Users are expected to adhere to the ethics codes of their respective credentialing bodies (e.g., BACB Ethics Code for Behavior Analysts). OTB Learning Group, LLC reserves the right to report ethical violations (such as plagiarism or fraudulent completion of CEUs) to the appropriate credentialing board.

9. Limitation of Liability

To the maximum extent permitted by law, OTB Learning Group, LLC and its owners, employees, or contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, lost revenue, loss of data, or business interruption) resulting from or related to your use of the website, your inability to access the website, or your use or application of information taught in our courses, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the website, Content, or services shall not exceed the amount paid by you to the Company in the six (6) months immediately preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless OTB Learning Group, LLC from any claims, losses, or damages (including attorney’s fees) arising out of your breach of these Terms, your misuse of the website, or your violation of any third-party rights or professional ethics codes.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Broward County, Florida.

11A. Time Limit to Bring Claims

To the fullest extent permitted by law, any claim or cause of action arising out of or related to the website, Content, services, or these Terms must be filed within one (1) year after such claim or cause of action arose; otherwise, the claim is permanently barred.

12. Recovery of Fees

In the event of any litigation or legal proceeding arising out of a breach of these Terms (specifically regarding intellectual property theft or non-payment), OTB Learning Group, LLC shall be entitled to recover its reasonable attorney’s fees and costs from the non-prevailing party.

13. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of significant changes by posting a notice on our website or via email. Your continued use of the website after such changes constitutes acceptance of the new Terms.

13A. DISCONTINUATION OF CREDENTIALING STANDARDS

Credentialing boards, regulators, and/or employers (including BACB®, QABA®, and IBAO®) may change, discontinue, replace, or update credentialing standards, training requirements, documentation requirements, renewal requirements, allowable CEU categories, accepted training formats, or audit/verification processes at any time.

You acknowledge and agree that:

  • We may issue training certificates, CEUs/PDUs, and related documentation under OTB Learning Group, LLC and/or the trade name “Outside the Box Behavioral Services” (as applicable for credentialing and compliance documentation), and such issuing name does not change the provider, your contractual relationship, or your obligations under these Terms.
  • We do not guarantee that any course, certificate, CEU/PDU, or training documentation will meet future requirements, will be accepted by any board or employer, or will remain valid/accepted if standards change.
  • You are solely responsible for confirming current requirements and acceptance with your credentialing board and/or employer before purchase, during training, and at the time of submission/renewal.

You consent to receive communications from us electronically (e.g., by email, through your account, or by notices posted on the website). You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

Where permitted by law, you further agree that your electronic submissions and actions (including clicking to accept these Terms, completing checkout, and using the website) constitute your electronic signature and your intent to be bound by these Terms and any related policies or agreements.
